1. Scope
 These Terms & Conditions apply to all rental agreements for the holiday property Wolke 26 (the "Property") between the landlords Till and Bengt Hoffmann (the "Hosts") and the renting party (the "Guest"). Deviating conditions of the Guest will not be recognised unless expressly agreed in writing.

2. Formation of Contract
The rental agreement is concluded upon receipt of a booking confirmation from the Hosts — by email or via the Smoobu booking platform. By completing a booking, the Guest accepts these Terms & Conditions. The Guest is responsible for the accuracy of all information provided at the time of booking.

3. Property Description
The property is Wolke 26, Embach, Municipality of Lend, Salzburg, Austria. It comprises approximately 140 m² of living space, three bedrooms, two bathrooms and a sun terrace of approximately 34 m². Maximum occupancy is 6 persons. Exceeding this limit is not permitted.

4. Rental Period and Minimum Stay
The minimum stay is 5 nights. Arrival and departure times by arrangement. Check-in is self-managed via a key box; the access code will be provided to the Guest before arrival. Check-out is by 11:00 AM on the day of departure unless otherwise agreed.

5. Rental Price and Payment
 The rental price is as shown at the time of booking. The following additional charges apply: End-of-stay cleaning fee: €200.00 (one-off, shown at booking) Tourist tax (Kurtaxe/Ortstaxe): charged per person per night and paid on-site. From May 2026: €3.05 per person/night as set by the Municipality of Lend. Changes to the officially set tourist tax are borne by the Guest. Payment is made in accordance with the payment conditions shown in the booking system. In case of non-payment, the Hosts reserve the right to withdraw from the contract.

6. Cancellation by the Guest
 Cancellations must be made in writing (by email). The following cancellation policy applies: More than 60 days before arrival: free cancellation 30 to 59 days before arrival: 50% of the rental price as cancellation fee Less than 30 days before arrival: 100% of the rental price as cancellation fee The date of receipt of the cancellation by the Hosts is decisive. Travel cancellation insurance is recommended.

7. Cancellation by the Hosts
The Hosts are entitled to cancel the contract for good cause — in particular in cases of force majeure, official orders or uninhabitability of the property through no fault of their own. In such cases, any payments already made will be refunded in full. Further claims by the Guest are excluded.

8. Pets
 Pets (dogs, cats and other small animals) are expressly welcome. The Guest is liable for all damage caused by pets. Pets must be supervised in outdoor areas.

9. Use of the Property
The property may only be used for holiday purposes. Smoking is prohibited throughout the interior. The maximum occupancy of 6 persons must not be exceeded. Events, parties or commercial use are only permitted with the express written consent of the Hosts. The Guest is required to observe the house rules (guest guide), which form part of this agreement.

10. Guest's Duty of Care
The Guest takes over the property in proper condition and is obliged to treat it with care. Damage beyond normal wear and tear is to be compensated by the Guest. Damage must be reported to the Hosts immediately. The property must be left tidy and swept clean on departure. End-of-stay cleaning is carried out by the Hosts against the stated fee.

11. Liability of the Hosts
The Hosts are not liable for damage caused by force majeure, natural events or the actions of third parties. Liability for material and financial damage is limited to cases of intent and gross negligence.

12. Bio Septic System
The property has a biological septic system. Only biodegradable products (toilet paper) may be disposed of in the toilet. Wet wipes, tampons, sanitary pads, chemicals and similar products are not permitted. Any damage resulting from non-compliance is borne by the Guest.

13. Data Protection
Personal data is processed in accordance with the Hosts' privacy policy and applicable data protection law (GDPR).

14. Governing Law and Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is — to the extent permitted by law — Zell am See, Austria.

15. Severability
Should any provision of these Terms & Conditions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
